Who operates Cognition

Cognition is operated by Perspective Global Pty Ltd and is available at cognitionapp.com.au and at the alternate address cognition.pixelverse.tech. References to "we", "us", "our", or "Cognition" in these terms mean Perspective Global Pty Ltd. "You" means the teacher, school, or student using the service.

What Cognition is, and what it is not

Cognition helps teachers understand what students have learned through a short, adaptive conversation. It produces evidence of understanding to support a teacher's professional judgement. It is not an AI-detection tool, a plagiarism detector, a proctoring system, or a grading authority, and its output must not be used as the sole basis for accusing a student of misconduct or for any consequential decision about a student. Cognition is a supporting tool. The teacher and school remain the decision-makers and are responsible for how results are interpreted and used.

Accounts and eligibility

• Teacher accounts are for educators and the staff their school authorises.
• You must provide accurate account information and keep it current.
• You are responsible for keeping your sign-in credentials secure and for all activity under your account.
• You must promptly notify us of any unauthorised use of your account.
• Students participate through a class code provided by a teacher and do not create accounts.

School authority and consents

By using Cognition with students, you confirm that you are authorised by your school to do so, and that you and your school have obtained any parental or guardian consents and provided any notices that your jurisdiction requires before students use the service. Responsibility for obtaining those consents rests with the teacher and school, not with Cognition.

Acceptable use

When using Cognition, you agree not to:

• Use the service for any purpose other than supporting genuine teaching and learning.
• Use the output as a sole or automated basis for disciplinary action or an accusation of misconduct.
• Attempt to identify, profile, or surveil students beyond the educational purpose of a task.
• Upload content you do not have the right to use, or content that is unlawful, harmful, or infringing.
• Attempt to extract, reverse engineer, or misuse the underlying AI models or prompts.
• Interfere with, probe, overload, or attempt to disrupt the security or integrity of the service.
• Use the service in violation of any applicable law or regulation.

We may suspend or terminate access that breaches these terms or that risks harm to students or the service.

Teacher and school responsibilities

Teachers and schools are responsible for obtaining any consents their jurisdiction requires, for supervising student use, and for interpreting results fairly and in context. Cognition provides information to inform a conversation between an educator and a student; it does not replace the educator's judgement. You are responsible for any decision you make with the assistance of the service.

Content and ownership

You retain ownership of the tasks you create and the work students submit. You grant us a limited, worldwide, non-exclusive licence to host and process this content solely to operate the service for you and to produce your results. We do not claim ownership of your content, and we do not use student content to train AI models.

Our intellectual property

The Cognition service, including its software, design, brand, and content we create, is owned by Perspective Global Pty Ltd and protected by intellectual property laws. These terms do not grant you any rights in our intellectual property other than the limited right to use the service as permitted here.

AI-generated output, accuracy, and limitations

Cognition uses artificial intelligence to generate questions and summaries. AI systems can make mistakes, misinterpret responses, or produce output that is incomplete or inaccurate. The output is provided to assist a teacher and must always be reviewed by a person before any decision is made. We make no representation that the output is error-free, complete, or suitable for any particular purpose, and you should not rely on it as the sole basis for any consequential decision about a student. Availability, changes, and early access

Cognition is offered during early access free of charge. We may add, change, suspend, or discontinue features at any time, and we may set or change fees for future paid plans with reasonable notice. We aim for high availability but do not guarantee that the service will be uninterrupted, timely, secure, or error-free, and we may perform maintenance that temporarily limits availability.

Third-party services

The service relies on third-party providers, including hosting, authentication, and AI model providers. Those providers operate under their own terms, and we are not responsible for their acts or omissions beyond our own reasonable selection and oversight of them.

Provided "as is" - disclaimer of warranties

To the maximum extent permitted by law, the service is provided on an "as is" and "as available" basis, without warranties or conditions of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the service will meet your requirements or operate without interruption or error. You use the service, and rely on its output, at your own discretion and risk. Nothing in this section limits any rights or guarantees that cannot lawfully be excluded, including under the Australian Consumer Law or other applicable consumer protection law; where such rights apply and cannot be excluded, our liability is limited, to the extent permitted, to re-supplying the service.

Limitation of liability

To the maximum extent permitted by law, Cognition, Perspective Global Pty Ltd, and our directors, employees, and providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or educational or reputational outcomes, arising out of or relating to your use of, or inability to use, the service or its output, whether based in contract, tort, negligence, statute, or any other theory, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the service will not exceed the greater of the amount you paid us for the service in the twelve months before the event giving rise to the claim, or one hundred Australian dollars (AUD $100). Because the service is currently provided free of charge, this amount will generally be the latter. Again, nothing in these terms excludes liability that cannot lawfully be excluded.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Cognition and Perspective Global Pty Ltd from any claims, damages, liabilities, and reasonable costs arising out of your use of the service in breach of these terms, your violation of any law, your failure to obtain required consents, or any decision you make based on the service's output.

Suspension and termination

You may stop using the service and delete your account at any time. We may suspend or terminate access if you breach these terms, if required by law, or to protect students, other users, or the integrity of the service. Provisions that by their nature should survive termination, including ownership, disclaimers, limitation of liability, and indemnification, will survive.

Governing law and disputes

These terms are governed by the laws of South Australia, Australia, without regard to conflict-of-law rules, and the courts of South Australia have non-exclusive jurisdiction, subject to any mandatory consumer-protection rights you have in your own jurisdiction. We encourage you to contact us first so we can try to resolve any concern informally.

General

If any provision of these terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with our Privacy Policy and Responsible AI Policy, are the entire agreement between you and us regarding the service. You may not assign these terms without our consent; we may assign them to a successor in connection with a merger, acquisition, or sale of assets.

Changes to these terms

We may revise these terms from time to time. If we make significant changes, we will update the date above and, where appropriate, notify account holders. Continued use of the service after a change means you accept the revised terms.
